Terms of Service

1. What Keepix is

Keepix is a photo and file app for Android and iOS. It signs in to your existing Telegram account and stores the photos and files you choose, at original quality, in a private channel inside that account. Keepix runs no servers of its own.

Keepix uses the Telegram API to connect to your account. It is an independent app: it is not affiliated with, endorsed by or made by Telegram.

2. Who can use Keepix

You must be old enough to use Telegram where you live (Telegram requires users in the EU, the UK and Australia to be at least 18), and at least [13, or the minimum age in your country]. If you are under the age of majority where you live, you need a parent's or guardian's permission.

3. Your Telegram account

• You need an existing Telegram account. The app cannot create one.
• Your use of Telegram, including the storage the app relies on, is governed by the Telegram Terms of Service (telegram.org/tos) and the Telegram Privacy Policy (telegram.org/privacy). You accept them when you sign in.
• Storage limits are set by Telegram: 2 GB per file, or 4 GB with Telegram Premium, with no cap on the total. Telegram can change these at any time, and we have no control over them.
• Telegram can suspend, limit or delete your account, or change the Telegram API, at any time. Any of these can affect the app and your backups.
• Telegram deletes accounts that stay inactive for the period chosen in Telegram's settings (18 months by default), with everything stored in them, including your backups. Keep using your Telegram account, or change this period in Telegram under Settings > Privacy and Security.
• You are responsible for keeping your Telegram account secure, including any two-step verification password.

4. Telegram is a separate service

Your backups are stored by Telegram, in your Telegram account, not by us. We do not operate, control or guarantee Telegram's service.

To the extent permitted by law, we are not responsible for Telegram's availability, security, storage limits, data retention or deletion, decisions about your account, or changes to its terms or API, or for any loss that results from them. Questions about your Telegram account belong with Telegram.

5. Your content

Everything you back up stays yours. Keepix claims no rights to your photos or files, never receives them and cannot see them. You are responsible for the content you store and for making sure you have the right to store it.

6. Backups, deletion and loss

• Nothing is uploaded unless you choose. The app does not back up automatically; every backup starts from your tap, and adding a photo to an album also backs it up.
• The backup badge on each tile shows whether a photo has been backed up. Check it before deleting the phone copy.
• Deleted items wait in the Recycle Bin for 30 days by default. The bin is kept per phone and does not sync.
• Deleting the ☁️ Keepix Unlimited Cloud Storage channel in Telegram deletes the backups. We cannot recover them.
• Keepix copies your files to your Telegram account; it is not a guaranteed backup service. We do not promise that your files will remain available, and we recommend keeping a second copy of anything you cannot afford to lose.

7. Acceptable use

• Use the app only lawfully and in line with the Telegram Terms of Service and these terms.
• Do not store or distribute content that is illegal or that you have no right to.
• Do not use the app to spam, abuse or overload Telegram's service, or to access accounts that are not yours.
• Do not copy, modify or reverse engineer the app, except where the law allows it.

8. Your licence to use the app

We give you a personal, non-exclusive, non-transferable and revocable licence to use the app on devices you own or control, for your own purposes, under these terms and the rules of the store you downloaded it from.

9. Plus

Keepix is free. A paid tier called Plus is designed but cannot be bought yet. Any prices shown in the app or on this site are placeholders and are not an offer. Terms for subscriptions, trials, renewals and refunds will be added before Plus goes on sale. [Draft subscription terms with the app stores' requirements in mind.]

10. Intellectual property

The Keepix app, its name, icon and design belong to [legal entity name]. Telegram's name belongs to its owner and is used here only to describe what the app connects to.

11. Changes to the app and to these terms

The app is version 1.0.0 and will change. Features described on this site as planned, such as automatic backup or several uploads at once, are not promises and may never ship.

We may update these terms. We will post the new version on this page with a new effective date and, for important changes, tell you in the app or on this website before they take effect. If you keep using the app after that, you accept the new terms.

12. Disclaimer of warranties

The app is provided “as is” and “as available”. To the extent permitted by law, we make no warranties of any kind, including that the app will be error-free or uninterrupted, that every backup will complete, or that Telegram's service will stay available. [Lawyer to review and localise.]

13. Limitation of liability

To the extent permitted by law, [legal entity name] is not liable for loss of data, including files stored in or deleted from your Telegram account; loss of access to your Telegram account; anything Telegram does or fails to do; or any indirect or consequential loss arising from your use of the app. Our total liability for any claim is limited to [the greater of the amount you paid us in the 12 months before the claim and USD 50].

Nothing in these terms limits liability that the law does not allow to be limited, such as liability for fraud or for death or personal injury caused by negligence, or your statutory rights as a consumer. [Lawyer to review, including the cap and non-excludable rights.]

14. Ending the agreement

You can stop using the app at any time: log out or uninstall it. Your backups remain in your Telegram account. We may stop offering the app or parts of it; because your files are in your own account, they are not affected by that.

15. If you got the app from Apple's App Store

• These terms are between you and us only, not Apple. We, not Apple, are solely responsible for the app and its content.
• Your licence is limited to using the app on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
• We, not Apple, are responsible for addressing any claims by you or a third party relating to the app, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
• If a third party claims that the app infringes its intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with any third-party terms that apply when you use the app, such as your mobile data provider's.
• Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, may enforce them against you.

16. If you got the app from Google Play

The Google Play Terms of Service also apply. Google is not a party to these terms and is not responsible for the app.

17. Governing law

These terms are governed by the laws of [jurisdiction], and disputes go to the courts of [venue], unless the law where you live gives you more protection. [Lawyer to confirm.]

18. General

If any part of these terms cannot be enforced, the rest stays in effect. These terms and the Privacy Policy are the whole agreement between you and us about the app. We may transfer them to a company that takes over the app; you may not transfer them without our consent.
